"Eight-Point Violation of Bans", Statute of Ancient Joson

"Eight-Point Violation of Bans" is the statute of Ancient Joson, the first slave state of Korea.

The statute reflects the demand and interests of the class of slaveholders.

Here is Doctor and Associate Professor Kwon Sung An, Section Chief of the History Institute under the Academy of Social Sciences.

"Only three articles of the 'Eight-Point Violation of Bans' have been handed down up to date.

First, anyone who kills a man shall be immediately punished with death. Second, anyone who inflicts a wound on others must compensate with cereals. Third, anyone who steals others' things shall be a slave of their owner, irrespective of sex, and if a criminal wants to be absolved from his or her crime, he or she must pay 500,000 of money.

As aforesaid, the 'Eight-Point Violation of Bans' is a cultural heritage of the Korean nation reflecting well the social reality of Ancient Joson during which the hostile confrontation and struggle between two classes with the slaveholders on one side and the slaves and commoners on the other side constituted the basis of the social relations."

Generally, the law of a slave state applied the principle of giving equal retaliation to the offender.

However, the "Eight-Point Violation of Bans" did not apply the principle but demanded the criminal compensate for the harm he did with cereals.

It proves well that the "Eight-Point Violation of Bans", the statute of Ancient Joson, was a quite developed law at that time.
